Neben dem <em>Commonwealth<\/em> bestehen Bundesstaaten. Erstaunlicherweise verf\u00fcgen aber beide Teile des Staates \u00fcber ein fast autarkes Gerichtssystem: <em>Federal System<\/em> und <em>State System<\/em>. Das einzige Gericht, das \u00fcber beiden Teilen steht, ist der <em>High Court of Australia<\/em>. Dieses Gericht ist sowohl Superrevisionsinstanz, als auch das einzige f\u00fcr Verfassungsfragen zust\u00e4ndige Gericht. Es vereint also die Aufgaben von Bundesverfassungsgericht und Bundesgerichtshof.<\/p>\n<h3><strong>Federal System<\/strong><\/h3>\n<p>Das <em>Federal System<\/em> besteht aus dem <em>Federal Court<\/em>, dem <em>Familiy Court<\/em> sowie dem <em>Federal Magistrates Court<\/em>. Das h\u00f6chste Gericht in diesem Instanzenzug (mal vom <em>High Court<\/em> abgesehen) ist der <em>Federal Court<\/em>. Ihm geh\u00f6ren 44 <em>Justices<\/em> unter der Leitung eines <em>Chief Justice<\/em> an und es hat Sitze in allen australischen Hauptst\u00e4dten, au\u00dfer Hobart und Darwin. Seine orgin\u00e4ren Entscheidungskompetenzen sind gesetzlich speziell definiert. Dar\u00fcber hinaus ist es jedoch auch Berufungsinstanz f\u00fcr die Entscheidungen seiner Einzelrichter und der Federal Magistrates Courts, sofern es sich nicht um familienrechtliche Angelegenheiten handelt.<\/p>\n<p>Der <em>Family Court<\/em> ist heute nicht lediglich f\u00fcr familienrechtliche Streitigkeiten zust\u00e4ndig, wenn auch sein Hauptaufgabenbereich weiterhin in diesem Bereich liegt. Auch der <em>Family Court<\/em> hat mehrere Sitze in den verschieden Bundesstaaten. Dem <em>Family Court<\/em> vorgeschaltet sind die <em>Family Law Registries<\/em>, Beratungsstellen, die einen Prozess vermeiden sollen, im Zweifel aber auch die ben\u00f6tigte Hilfestellung f\u00fcr einen Prozess leisten.<\/p>\n<p>Der <em>Federal Magistrates Court<\/em> dient als Filter um sowohl den <em>Federal Court<\/em> als auch den <em>Family Court<\/em> zu entlasten. Seine Richter sitzen in diversen St\u00e4dten in Australien. Dar\u00fcber hinaus gibt es aber auch noch Gesch\u00e4ftstellen (<em>Circuits<\/em>), die nicht stetig besetzt sind, sondern von verschiedenen Richtern abwechselnd betreut werden. Diese \u201erotierende Instanz\u201c soll dazu dienen den B\u00fcrgern in abseitsgelegenen Regionen einen g\u00fcnstigeren Zugang zum Gericht zu erm\u00f6glichen.<\/p>\n<p>Letztlich besteht eine Vielzahl von <em>Tribunals<\/em>, die die Gerichte dadurch entlasten, dass sie im Vorfeld \u00fcber Verwaltungsfragen entscheiden. Dabei handelt es sich nicht um Gerichte, sondern eher um eine Widerspruchsbeh\u00f6rde und damit um einen Teil der Exekutive. Erst wenn die <em>Tribunals<\/em> auf Antrag hin nicht t\u00e4tig werden, bzw. wenn eine beantragte Entscheidung abgelehnt wird, ist der Rechtsweg zum Verwaltungsgericht er\u00f6ffnet.<\/p>\n<h3><strong>State System<\/strong><\/h3>\n<p>Im <em>State System<\/em> existieren <em>Local Courts<\/em>, <em>District Courts<\/em> und <em>Supreme Courts<\/em>. Die unterste Ebene bilden dabei die <em>Local Courts<\/em>. Diese sind in Zivil- und Strafsachen zust\u00e4ndig, soweit der Streitwert nicht \u00fcber einem, von Staat zu Staat unterschiedlichem, H\u00f6chstbetrag liegt.<\/p>\n<p>In den meisten Staaten bilden <em>District Courts<\/em> die n\u00e4chste Instanz. Diese sind sowohl f\u00fcr erstinstanzliche Entscheidungen zust\u00e4ndig, solange der, wiederum vom Staat abh\u00e4ngige, H\u00f6chststreitwert nicht \u00fcberschritten wird, als auch f\u00fcr Berufungssachen der <em>Local Courts<\/em>.<\/p>\n<p>H\u00f6chstes Gericht im <em>State System<\/em> (wiederum ohne Beachtung des <em>High Courts<\/em>) ist der <em>Supreme Court<\/em>, von dem es in jedem Bundesstaat Australiens einen gibt. Dem Gericht stehen sowohl erstinstanzliche Entscheidungskompetenzen, als auch Berufungssachen zu.
